POA (Power of Attorney)
North Phoenix & North Scottsdale call for additional locations available
Please note:
A POA becomes void once it is revoked by the signing party, or that signing party has passed away.
The signing party must be of sound mind and not being coerced.
They also can not be taking any medicine that will cloud their thought process.
What a POA usually covers (examples)
-
Depending on the form, it may allow an agent to:
-
Sign applications and supporting documents
-
Request records or submit paperwork
-
Deal with titling/registration/closing steps
-
Manage payments or other transaction actions
-
******Quick practical note******
-
If the POA is being used for a specific type of transfer (like vehicles, mobile homes, real estate, or financial paperwork), the receiving office often expects a POA with the right wording and, in many cases, notarization and/or a specific form.
Power of Attorney (POA) is a legal document
that lets someone else act on your behalf.
POA's in Arizona requires notarizations and 2 witnesses.
When you need a POA
You’ll typically need one when you can’t personally sign or handle a transaction, and the another person must act instead.
-
Common examples:
-
You’re signing paperwork for a real estate/vehicle/other transfer but you can’t be present.
-
You’re delegating authority to an agent (attorney-in-fact) to sign documents, make decisions, or manage filings.
-
The transaction requires signatures by a specific deadline and the authorized person can handle it faster.
-
A lender or government agency requires it for certain steps when a representative is acting for the owner/borrower.
-
Hospitalization/Medical Limitations/Health Related Limitation
-
Financial assistance
-
Why it’s needed
-
A POA is used to:
-
Prove legal authority: it shows the person signing for you has permission.
-
Keep the deal moving: the representative can sign and submit documents without you being there.
-
Reduce delays: agencies/escrow/title companies often won’t accept signatures from someone without documented authority.
-
Clarify scope: it can be limited to specific tasks (for example, only vehicle registration paperwork or only closing documents).
-
General POA to help with specific financial needs.
